Minimum Senator Count Constitutional Amendment Act

Title

1. This Act shall be titled the Minimum Senator Count Constitutional Amendment Act.

Amendments

2. Section 2.1.5 shall be amended as follows:
Current Text wrote:2.1.5. Existing senators of the Senate shall remain as active Senators until the conclusion of an election, at which point they are replaced. Should this occur during the process of a vote, that vote shall be restarted with the new members of the Senate taking up the vote.
Proposed Text wrote:2.1.5. Existing senators of the Senate shall remain as active Senators until the conclusion of an election, at which point they are replaced, even if no new Senators are elected. Should this occur during the process of a vote, that vote shall be restarted with the new members of the Senate taking up the vote.
3. Section 2.6 shall be added after the current Section 2.5 that shall read:
Proposed Text wrote:2.6. During anytime where there are only two Senators in the Senate, the Councillor of the Senate shall act as an acting-Senator. During anytime where there is only one Senator in the Senate, both the Councillor of the Senate and the Councillor of Security shall act as acting-Senators. Should there be any reason that either of these Councillors cannot fulfil this role, the Council of Brilliance shall appoint one of their members to fill the role in their stead.

2.6.1. Acting-Senator's have all powers provided to a Senator given in this Constitution except that they are not eligible to be appointed as Senate Manager.
4. Section 3.1.3 shall be amended as follows:
Current Text wrote:3.1.3. During a State of Lapse, or during anytime where the Senate is not in session, excluding a Senate recess, Councillor's that are appointed must be approved by a referendum instead.
Proposed Text wrote:3.1.3. During a State of Lapse, or when the Senate is not in session, excluding a Senate recess, or during anytime where there are less than the minimum number of Senators as defined by the Constitution, Councillor's that are appointed must be approved by a referendum instead.

A proposed constitutional amendment to allow the Senate to run with minimum Senators even when we only have one citizen elected. If we have no citizens running at any time, the Senate becomes inert until such time as we do.

It does mean a few Council members doubling up duties and voting on the same legislation twice in two different roles, but at least there is a working Senate.
