Directive 007: Constitutional Amendment

Given that roleplayers are still under represented in our regions Consitution despite being the most active of roles, that the Senate is still not filled despite recent changes, and that the Council mostly remains empty, and wishing to rectify these issues, in accordance with the powers granted by the Constitution to the Council of Brilliance, we hearby issue this legally binding directive:

1. Under Section 8.1 the Grand Master and the Council of Brilliance issue a temporary State of Emergency for the purpose of bypassing the inactive Assembly. This temporary State of Emergency shall last until such time as the noted referendum in this directive either passes or fails. This State of Emergency grants the Council of Brilliance the power to propose amendments to the Constitution in place of the Assembly as per Section 9 of the Constitution.

2. The Council of Brilliance hereby proposes the following constitutional amendment to be presented to the citizens of Cynosure in a referendum as per the second part of Section 9 of the Constitution starting three days following the publication of this directive:

1. This Act shall be titled the Regional Roleplayer Constitutional Amendment Act.

Amendments

2. The preamble shall be amended as follows:

3. Sections 1.6 and 1.6.1 shall be added after the current Section 1.5.2 that shall read:

A regional roleplayer role may be granted by any member of the Council of Brilliance, subject to security checks by the Masters of Cynosure, in accordance with the process outlined by law. No one on the regional blacklist may be admitted with a roleplayer role. Roleplayers shall be granted access to participate in roleplay and cultural aspects of the region only, though they may view other areas, and they may be granted rights as defined in this Constitution by directives and statute.

1.6.1. Roleplayer's shall be permitted to join Ministries for Internal Affairs, Culture and Roleplay.
4. Section 2.3.6 shall be amended, and Section 2.3.7 shall be added after the current Section 2.3.6, as follows:

Should any chamber during a term fall below the minimum member requirements due to a vacancy, it shall immediately end the term and Senate elections shall be held in full, regardless of time remaining in that term. That chamber shall in addition be dissolved, with no members staying on as active members during the election period.

Should both chambers be unable to meet minimum member requirements for a period exceeding 30 days, the Grand Master shall be empowered with the powers provided to the Assembly as a whole, excepting those already granted to the Council of Brilliance, until such point as the election period successfully concludes. This does not constitute the Grand Master acting as either the House of Brilliance or the Senate, for the purposes of other areas of legality. Active recess dates apply to this provision.

2.3.7. Should any chamber during a term fall below the minimum member requirements due to a vacancy, it shall immediately end the term and Senate elections shall be held in full, regardless of time remaining in that term. That chamber shall in addition be dissolved, with no members staying on as active members during the election period.
5. Section 2.4.3 shall be amended as follows:

6. Sections 3.1.1 and 3.1.2 shall be amended as follows:
Current Text wrote:3.1.1. When a position in the Council of Brilliance is open, the Council of Brilliance shall choose amongst themselves one Councillor who shall fill this position as an interim Councillor.

3.1.2. When the Council of Brilliance unanimously agree on a replacement for an interim position, and the citizen in question has agreed to taking upon the position, the Council of Brilliance shall announce their decision to the Senate, who shall approve or deny the appointment.

The Council of Brilliance shall then choose amongst themselves one Councillor who shall fill this position as an interim Councillor until such time as the departed Councillor returns, at which point the departed Councillor shall resume their duties; or thirty days have passed without any update from the departed Councillor, at which point the position shall be considered open.
9. Section 3.4.4 (renumbered previously to 3.4.3) shall be amended as follows:

Directive 002

11. This legislation repeals Section 1 of Directive 002 as part of its passage.

Notes

12. It shall be noted that Councillors can still take noted absences, and that any Councillor that loses citizenship or passes through a successful Vote of No Confidence can be removed from office, and this amendment's intention is to tidy the process on inactive or absent Councillors.
